Terms of Service

1. Introduction

These are the terms (the "Terms") that you ("You") must agree to in order to use Candy Attack (the "Game") and any associated websites or backend web services (collectively, the "Websites"). Together, the Game and the Websites form the service (collectively, the "Services").

The Services are created by Potato Bomb Studio ("We" or "Us"), and the Game is hosted on platforms such as Google Play Store, Apple App Store, and others (collectively, the "Platforms"). By agreeing to these Terms, you also agree to our Privacy Policy.

We own all rights, including intellectual property rights, to the Services. We grant you a non-exclusive, revocable, limited license to use them. Any rights not explicitly granted in this agreement remain ours.

2.  Age of Users

Children 12 and under are not allowed to use our Services. If you are 13 to 17 (a “teenaged minor”), you must have parental or legal guardian permission to use our Services.

If you are a parent or guardian allowing a teenaged minor to use our Services, you agree to:
(i) review and use any parental controls we provide,
(ii) supervise their usage,
(iii) set appropriate limits,
(iv) ensure they follow these Terms, and
(v) take responsibility for their actions while using our Services.

3. User Responsibilities & Code of Conduct

What You Can Do:

-       Play the Game in any setting, including tournaments.

-       Record and share gameplay, including on monetized platforms like YouTube.

-        Create derivative works using official artwork with our written permission.

What You Cannot Do:

-        Reverse engineer, decompile, or modify any part of the Services.

-        Distribute, sell, rent, or monetize the Services in any form.

-       Incorporate the Services into other products.

-       Use bots, AI, or automated scripts to interact with the Services.

-       Share or promote sexually explicit content, violence, or discrimination.

-       Create material that could harm Us, the Services, or its users.

Failure to follow these rules may result in penalties, including account suspension.

4. Intellectual Property

All rights to the Services, including games, content, trademarks (“Potato Bomb Studio”, “Battle Chains”), and Virtual Items, belong to us or our licensors.

While playing, you may acquire Virtual Items (e.g., cosmetics, achievements, expansion packs) through purchases or gameplay. You are granted a non-exclusive, non-transferable, revocable license to use them within the Game, but you do not own them. We may modify or remove any Virtual Item at any time.

Unauthorized use of our trademarks is strictly prohibited. No one other than us or authorized parties may sell or distribute our Services. You acknowledge that you have no ownership rights in our Services or Virtual Items.

If you believe content on our Services infringes your copyright, contact us via Email with details of the infringement claim.

By providing us with any ideas, suggestions, or materials ("Feedback"), you grant us an unlimited, irrevocable right to use them freely without restriction, compensation, or attribution.

5. In-App Purchases & Payments

All purchases made through our Services, including access to Virtual Items, are final and non-refundable, except at our sole discretion or where required by law or Platform policies.

You are responsible for all charges made through your account, including unauthorized transactions by third parties. If our Services are terminated or your access is suspended, you will not receive a refund or compensation for unused Virtual Items, unless required by law.

We may modify or discontinue any aspect of our Services, including the availability of Virtual Items, at any time. The presence of an item or offer does not guarantee its future availability. Changes take effect immediately upon posting.

6. Account Termination & Suspension

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or disrupt the Services.

If your account is terminated, you will lose access to the Game, Virtual Items, and any progress made. We are not obligated to provide refunds or compensation for lost content.

You may also choose to delete your account at any time, but this action is permanent and cannot be reversed.

7. Disclaimers & Limitation of Liability

Our Services are provided "as is" and without guarantees. We do not promise uninterrupted or error-free gameplay, and we are not responsible for any losses caused by issues like bugs, crashes, or service interruptions.

To the extent permitted by law, our liability for any loss is limited to the total amount you have paid to us in the last 6 months before the loss occurred. If you have not made any payments, we assume no liability. We are not liable for any indirect, incidental, or consequential damages

8. Privacy

Refer to our Privacy Policy to understand what information we collect, how we use it, and your choices regarding your data. By using our Services, you consent to our data practices as outlined in the Privacy Policy, except where laws require additional consent.

9. Changes to the Terms

We may update these Terms and will notify users within the Game. Continuing to use the Services after an update means you accept the revised Terms.

10. Governing Law & Dispute Resolution

These Terms do not override any legal rights you have under the laws applicable to you. If any part of this agreement conflicts with your legal rights, those rights remain unaffected.

By using our Services, you agree that any disputes related to the Game or these Terms will be resolved individually and not through class actions or group arbitrations. You waive the right to participate in any collective legal proceedings against us.
